No one likes to think about death or preparing a will, but having an up-to-date will in Texas is very important for many reasons. If you were to die intestate (without a will), the courts would decide what happens to your estate, and the way they decide to distribute it may not be in the best interest of your loved ones. Outlined below are a few reasons why having a current Texas will is necessary.

1. Your estate may not pass to the right people. When someone dies without a will, their estate passes to their spouse, children, and in some cases to some of their grandchildren. This can be a problem if you have an estranged child, if someone claims to be your child after your death, or, if you have no children, your spouse could share your estate with his or her in-laws, which could potentially be an uncomfortable situation for them.

2. If children are involved, the distribution can be complicated without a will. Under Texas intestacy laws, children will receive their distribution when they turn 18. In your will, you can create a trust to help the young adults make sound financial decisions. Also this type of trust can help to keep creditors and ex-spouses from receiving parts of the children’s shares. If the children are minors and you have no will, a guardian will be appointed by the court and can be a great influence on how your estate is distributed and used. In your will, you can specify who you would like to be the guardian instead of the court choosing for you.

3. If your will is outdated, it may not further your present intentions. Having an outdated will can be just as bad as or worse than not having a will at all. An ex-spouse or distant relative may collect on your estate. You may end up leaving significant assets to people you no longer intend to be beneficiaries or to the heirs of deceased beneficiaries.
