General Information and Process for Divorce:
Every case is somewhat different depending on the particular circumstances, and in particular, whether or not children are involved and whether the divorce is contested or uncontested. A contested divorce is when the spouses do not agree on how they are going to divide the property, child custody, etc. and therefore, either the court will make a decision on these matters, or they will be resolved by some other form of dispute resolution such as mediation. An uncontested divorce usually involves parties who agree on how they want to split everything. Generally, the stages of a divorce case are as follows:
• FREE initial consultation—to learn the circumstances of your case and discuss possible courses of action.
• Filing a petition for divorce—this must be done in the court of proper jurisdiction and the other party must be served with process.
• Discovery—this is an information gathering period where both sides, among other things, collect documents and take depositions to learn about each of the spouses.
• Alternative Dispute Resolution—the current trend is for a case to go through alternative dispute resolution (mediation, arbitration, informal settlement conference, collaborative law) before the case can go to trial in hopes that there will not be a need for trial.
• Trial—if the case is unable to settle during the alternative dispute resolution stage, then the case will go to trial, and a judge will make a decision on the case.
